Foreign Intervention
A foreigner, or foreign entity, aiding a candidate directly or indirectly, or spending for a candidate’s campaign
Prohibited Campaign Propaganda
- Printed materials such as leaflets, exceeding eight and one-half inches (8 ½”) in width and fourteen inches (14”) in length
Posters made of cloth, paper, cardboard or any other material, whether framed or posted, with an area exceeding two feet (2’) by three feet (3’)
Streamers exceeding three feet (3’) by eight feet (8’) in size displayed at the site and on the occasion of a public meeting or rally. - Said streamers displayed more than five (5) days before the date of the meeting or rally or NOT removed within twenty-four (24) hours after said meeting or rally
- Use of hazardous materials in campaign materials; use of plastics in jurisdictions where plastics are banned
- Absence of this information on printed propaganda material: “political advertisement paid for,” followed by the true and correct name and address of the candidate or party for whose benefit the election propaganda was printed or aired; and “political advertisements paid by,” followed by the true and correct name and address of the payor
- To print, publish, broadcast or exhibit any such election propaganda donated or given free of charge by any person or publishing firm or broadcast entity to a candidate or party without the written acceptance by the said candidate or party and unless they bear and be identified by the words “printed free of charge,” or “airtime for this broadcast was provided free of charge by”, respectively, followed by the true and correct name and address of the said publishing firm or broadcast entity
- To show, display or exhibit publicly in a theater, television station, or any public forum any movie, cinematography or documentary portraying the life or biography of a candidate, or in which a character is portrayed by an actor or media personality who is himself a candidate
- To post, display or exhibit any election campaign or propaganda material outside of authorized common poster areas, in public places, or in private properties without the consent of the owner thereof.
NB: “Public places” include any of the following:
- Electronic announcement boards, such as LED display boards located along highways and streets, LCD TV displays posted on walls of public buildings, and other similar devices which are owned by local government units, government-owned and controlled corporations, or any agency or instrumentality of the Government;
- Motor vehicles used as patrol cars, ambulances, and other similar purposes that are owned by local government units, government-owned and controlled corporations, and other agencies and instrumentalities of the Government, particularly those bearing red license plates;
- Waiting sheds, sidewalks, street and lamp posts, electric posts and wires, traffic signages and other signboards erected on public property, pedestrian overpasses and underpasses, flyovers and underpasses, bridges, main thoroughfares, center islands of roads and highways;
- Schools, shrines, barangay halls, health centers, public structures and buildings or any edifice thereof;
- Public utility vehicles such as buses, jeepneys, trains, taxi cabs, ferries, pedicabs and tricycles, whether motorized or not;
- Within the premises of public transport terminals, such as bus terminals, airports, seaports, docks, piers, train stations, and the like.

COMELEC Resolution 9615 Section 9c states:
“Said online advertisement, whether procured by purchase, or given free of charge, shall not be published more than three times a week per website during the campaign period. For this purpose, the exhibition or display of the online advertisement for any length of time, regardless of frequency, within a 24 hour period, shall be construed as one instance of publication.”
Is the frequency cap per user?

This is the frequency cap for the advertiser. In other words, the candidate taking out the ad should make sure that his contract with the advertiser conforms to this requirement.

Outside of the campaign period, are campaign streamers allowed in barangay halls and other public buildings?
Outside the campaign period, there are no prohibitions for displaying streamers and such.
Kabilang ba sa mga violations na ito ang mga text brigade na nagpapakalat ng malicious and misleading information laban sa kanyan mga kalaban? Ang Alay Buhay Partylist ay nagpapanggap na Buhay (Hayaang Yumabong)Partylist. Maging ako ay nakatanggap ng text nitong na nagki-claim sa info ng Buhay (Hayaang Yumabong) ngunit nasa pangalan ng epal na Alay Buhay na yan. Ano ang action dito ng COMELEC?
Hindi po nire-regulate ng COMELEC ang gamit ng text o SMS.

I call the attention of COMELEC office on October 1,2013 during the first day in filing of certificates of candidacy.
Also a letter of invitations was sent requesting a representative from COMELEC to attend a seminar regarding RA8491 also know as the Philippine Heraldic Code.
Again I would like to call the attention of COMELEC and be reminded of the provisions of the law.
I. Prohibited Acts
Sec. 34. It shall be prohibited:cralaw
a) To mutilate, deface, defile, trample on or cast contempt or commit any act or omission casting dishonor or ridicule upon the flag or over its surface;
b) To dip the flag to any person or object by way of compliment or salute;
c) To use the flag:
1) As a drapery, festoon, tablecloth;
2) As covering for ceilings, walls, statues or other objects;
3) As a pennant in the hood, side, back and top of motor vehicles;
4) As a staff or whip;
5) For unveiling monuments or statues; and
6) As trademarks, or for industrial, commercial or agricultural labels or designs.
d) To display the flag:
1) Under any painting or picture;
2) Horizontally face-up. It shall always be hoisted aloft and be allowed to fall freely;
3) Below any platform; or
4) In discotheques, cockpits, night and day clubs, casinos, gambling joints and places of vice or where frivolity prevails.
e) To wear the flag in whole or in part as a costume or uniform;
f) To add any word, figure, mark, picture, design, drawings, advertisement, or imprint of any nature on the flag;
g) To print, paint or attach representation of the flag on handkerchiefs, napkins, cushions, and other articles of merchandise;
h) To display in public any foreign flag, except in embassies and other diplomatic establishments, and in offices of international organizations;
i) To use, display or be part of any advertisement or infomercial; and
j) To display the flag in front of buildings or offices occupied by aliens.

I wouldn’t have minded if they started at 8am but 6:30 is too early! And you’re saying it’s allowed po kahit anong oras sila mangampanya? That is so unfair.

I heard today, Feb14, on TV the illegality of candidates prematurely campaigning thru product endorsements. I recalled then in many occasions where I saw pictures of Chiz Escudero and a particular product as merchandising signages at back portion of buses (sometimes on billboards). Why didn’t you discontinue this? Isn’t this ground for disqualification too? Isn’t it that people who wants to become lawmaker must learn to observe the law first?

However, may i ask—Do tarpaulins of politicians that have their pictures and say Happy Holidays or Happy Fiestas or Thru the efforts of Mayor or Councilor and such constitute as campaign material? If yes, can they be also removed? There are a lot of those proliferating Mandaluyong, particularly along the Barangka Drive area.
An incumbent mayor in our city brandishes his ‘accomplishments’ of support to the victims of Sendong. There is a huge billboard the size of Mt Everest that stands tall in the middle of our city central park. The mayor is seeking re-election in coming May. His billboard, while set up 12 centuries ago, continues to exist and stand today.
Questions: Will his billboard now qualify as an election paraphernalia, notwithstanding the outdatedness of his message?
If not, what crime can be filed against an ordinary citizen who defaces the billboard because it looks–ugly?
Since comelec limits the ad on tv, how can it make sure na hindi lumalapas ang campaign ad? do they have persons to monitor every station and radio companies?

where can we file a complaint against the councilors who violated the campaign rules in the area. it seems that the comelec in Cebu doesn’t do their job to crack down those violators.

JaMGGo – Jagna Movement for Good Governance spearheaded by our parish priest and campaigns for a clean, credible, honest, orderly and peaceful elections plans to install a 10 ft. by 8 ft. tarpaulin poster at the bell tower of the Catholic Church with the following message:
“VOTE BUYING AND VOTE SELLING ARE NOT ONLY CRIMES; THEY ARE ALSO EVIL ACTIONS. JAGNAANONS ARE NOT STUPID. WE DON’T SELL VOTES.”
Is this allowable under Comelec Resolution No. 9615?

Are the candidates allowed to advertise their faces on the Billboard? I mean literally Billboard size posters. And also, are the re-electionist allowed to put their faces and names on the current activities or projects of the city? I think they are not allowed to post their ugly faces on any of the posted tarps for the activity.
and also, if the comelec is reading this forum and if this is really the comelec’s website, then this site should be checked regularly by the person in charge by the comelec to respond to the questions since the comelec knows that this is where the people will report illegal activities.

Pls i just want clarifications:
For privately owned vehicles used for campaign with posters and campaign ads ay hindi bawal dahil it is not used for Local Government vehicle units and are also not Public Utility vehicle either.
The only bawal are vehicles that are: 1. Motor vehicles used as patrol cars, ambulances, and other similar purposes that are owned by local government units, government-owned and controlled corporations, and other agencies and instrumentalities of the Government, particularly those bearing red license plates; and
2. Public utility vehicles such as buses, jeepneys, trains, taxi cabs, ferries, pedicabs and tricycles, whether motorized or not;
Tama po ba ang pagkaunawa ko? Then, why would anyone apprehend a privately owned vehicle who use a legal size posters for campaign?
They could not even apprehend vote buying.. NOT ONE, posters? Clarification for online campaign software:
Kindly evaluate an online campaign software I developed that would allow supporters of a candidate/party to sign up as campaigners. The software is a Facebook App that aims to organize online supporters into a virtual campaign team whose task is to engage the viral functions constituted therein. My question is would these online campaigners be eligible for compensation?

according to comelec rules bawal campaign posters sa mga poste, puno, telephone/electric wires, barangay halls and public schools. according to a QC ordinance bawal din ito. ang hindi ko maintindihan kahit bawal, lantaran na nagkalat ang mga illegal posters dito sa QC. both administrative and opposition candidates violate both laws. parehas silang ayaw sumunod. parehas silang nagrereklamo. if law makers/enforcers could openly violate the law, who would protect us. lead by example. ito ang tamang daan. ito ang “dapat tama”. ty

ano ba penalty sa violation posting area rule? kung hindi perpetual disqualification or imprisonment, wala matatakot at susunod dito. kung simple patawag o sermon lang, useless ito. matigas ulo mga pinoy. mahilig sa bawal at palusutin. useless operation “baklas”. baklas-kabit lang tayo. we need to ammend comelec rules. make stronger. barangay elections is coming this october. Is a candidate or his campaign team allowed to attend a birthday celebration cum medical mission hosted by a private individual? This medical & dental mission is held annually by the host to celebrate her birthday and not for the campaign period.

Serious threats (excerpts)
Considering that a blogger’s house was riddled not with bullets but with stones recently in the middle of the night, followed days later by sightings of total strangers intruding into his yard as vigilant neighbors kept watch in the dark (apparently in retaliation for certain posts made in his blog); considering that supporters of certain candidates are constantly and boldly harassed by toughies in motorcycles, one incident occurring two nights ago in Mogpog when a campaign organizer was harassed by men in motorcycles preventing the victim from doing her job (reported to the local police which immediately responded and entered the details in its blotter); considering reports of heavily armed goons in certain localities whose presence there are no longer secret as of now with people expressing grave concerns; considering that a certain group of disgruntled goons from outside Marinduque, hired to disrupt local elections in fact voluntarily surrendered for protection to the Sta. Cruz police after making shocking revelations of physical harassments, the existence of many other groups and planned assassinations – all these confirm that the stern balikbayan’s warning has clear basis in fact.
All these appear to be more serious now because without election violence and disruption, at stake apparently is the previously unthinkable downfall of a political clan that has only produced a vicious cycle in Marinduque’s political system. That’s one characterized by patronage, corruption, fraud, deception and manipulation of the helpless poor people – all in the spirit of power monopoly and greed.

April 24, 2013 Poster of Mark Villar for congressman and Diwa were posted on my property wall w/o my permission.
My steel door was used to post a poster by Abono partylist and Beside the door was Cynthia Villar poster. I took picture of it, removed the posters but then I forgot my cellphone and got lost. I still have the evidence if needed.
I commend the Comelec here in Bauan, Batangas for conducting “operation baklas” of oversized posters this week. There are still posters illegally displayed in tricycles and jeepneys. The candidates’ posters that were spotted on these vehicles are Ranie Abu, Godofredo Berberabe, Ryan Dolor, Rommel Basilan, Ava Talag, Presnet Bacal, Neil Valdez,Marvey Marino. I hope the Comelec will conduct “operation baklas” in a relentless manner here in Bauan.

Wala bang violations for so much noise. Here sa Taguig, in a residential area, may restaurant na continuously nagpapatutog ng jingle ni Lino Cayetano sa loud speaker along the road na ang pwesto pero rinig mo hanggang sa mga bahay sa sobrang lakas.
Then meron din kay Arwin Alit na truck na nakatambay sa may street namen na continuously nagpapatugtog at sabay pa sila.

I received flyers from a certain Rhea Herrera running for councilor in QC. This would have been fine except that her camp acquired personal details about me, including my id picture, signature (!!!), full name, birthday, and address. I believe these personal information are ill gotten from the government database (Comelec or LTO, not sure) which I have never agreed to be shared with electoral candidates.
This is a matter of violating every citizen’s privacy for the sake of campaigning.
Here in Lingayen,Pangasinan some campaigners are giving plastic stool chairs,a plastic full of groceries,and cash with the name of the candidate attach,on every house…is this Illegal??

WE also received same type of campaign sticker here in qc. Rhea Herrera’s campaign sticker has my mother,father and brother’s complete voter’s id information at the back specifically picture,signature,address,birth date and full name,precinct no,polling station. etc.It’s a total invasion of privacy ang giving out private information which is supposed to be confidential!
I personally don;t have that sticker with my information even if i’m a registered voter with my brother who received one.What if i also have the same sticker and it was just scattered in the street.my personal information could be used by other people for fraud!they might even practice how to forge my signature!This is totally wrong!Why do they have to write those information.What if someone would go to our house and pretend they know us.
